STRUCTURE OF COURTS
A.
CIVIL
In exercise of
powers conferred by sections 3-6 read with all other
enabling provisions of the Mizoram Civil Courts Act,2005
as amended, and in prior consultation with the Hon’ble
Gauhati High Court, the Governor of Mizoram had
constituted following two Judicial Districts in the
State of Mizoram, namely-

A.12011/32/06- LJE, the 7th January, 2008
published in the Mizoram Gazette, Extra Ordinary Vol.
XXXVII, 8.1.2008 Pausa 17, S.E.1929, Issue No.2]
1.
Aizawl Judicial District
comprised of the areas covered by the existing
administrative and revenue districts of Aizawl,
Champhai, Kolasib, Mamit and Serchhip.
2.
Lunglei Judicial District
comprised of the areas covered by the existing
administrative and revenue district of Lunglei for the
time being.
The Governor of Mizoram is further pleased to set up
following Civil Courts in the above mentioned Judicial
Districts, namely-
1.1
In Aizawl Judicial District-One Court of District Judge, three Courts
of Additional District Judges, three Courts of Senior
Civil Judges and seven Courts of Civil Judges at Aizawl
to sit in the District Court
building at
Aizawl.
1.2
One Court of Senior Civil Judge and three Courts of
Civil Judges at Champhai to sit in the Additional
Sub-District Council Court building, Champhai.
1.3
One Court of Senior Civil Judge and three Courts of
Civil Judges at Kolasib to sit in the District Court
building at Kolasib.
1.4
One Court of Senior Civil Judge and one Court of Civil
Judge at Mamit to sit in the building to be specified by
the Government immediately, and
1.5
One court of Senior Civil Judge and one Court of Civil
Judge at Serchhip to sit at the building to be specified
by the Government immediately. The Government shall
allocate the existing Court Staff to these newly created
Courts immediately and provide further Staff as may be
required without any delay.
2.1
In Lunglei Judicial District- One Court of District Judge, one Court of
Additional District Judge, two Courts of Senior Civil
Judges and five Courts of Civil Judges at Lunglei to sit
in the District Court building at Lunglei.
3. The jurisdiction of the said Courts has been outlined by
the Hon’ble Gauhati High Court in their communication
dt.12.12.2007 as below:
(a)
The District Judge/Additional District Judge at Aizawl
shall have territorial jurisdiction over the undivided
Aizawl administrative district viz.Aizawl, Kolasib,
Champhai, Serchhip and Mamit.
(b)
Senior Civil Judge/Civil Judge shall exercise
territorial jurisdiction within the area of their
respective administrative districts.
However, the recently created administrative districts
of Serchhip and Mamit do not have Court establishments
like Staff, Jails etc. and due to this reason and
shortage of Judicial Officers, posting of Judicial
Officers to these districts is differed for the time
being. Accordingly, Judicial Officers of appropriate
grades posted at Aizawl may exercise jurisdiction over
these districts as may be ordered by the High Court.
(c)
Civil Courts of Lunglei District may exercise
jurisdiction over the entire Lunglei District including
Saiha and Lawngtlai districts, if and when the latter
two districts which fall under the area of the sixth
scheduled to the Constitution and excluded from the
scheme of separation of judiciary, are included in the
said scheme.
B.
CRIMINAL
In exercise of the powers conferred by sections 6,7,9,11
and 12 of the Code of Criminal Procedure, 1973 (Act No.
2 of 1974), the Governor of Mizoram, after consultation
with the Hon’ble Gauhati High Court, had constituted the
following Sessions Division in the state of Mizoram,
namely:- [Notified under No.A.12011/32/06 - LJE: Dated Aizawl, the 2ndJune,
2008 [Vide, the Mizoram Gazette, Extra Ordinary: Vol.
XXXVII, 12.6.2008, Jyaistha 22, S.E. 1930, Issue No.
197] and amended under even No. Dated Aizawl, the 7th
Oct., 2008 [Vide, the Mizoram Gazette, Extra Ordinary:
Vol. XXXVII, 24.10.2008. Kartika 2, S.E. 1930, Issue No.
430] with the approval of Hon’ble Gauhati High Court
Vide, No. HC. VII-14 (PT)/2007/8467/A Dated 25th
August, 2008 and is marked as *.]

1.1 Aizawl
Sessions division comprised of the areas covered by
the existing administrative and revenue districts of
Aizawl, Champhai, Kolasib, Mamit and Serchhip.
1.2 Lunglei Sessions division comprised of the areas covered by the
existing administrative and revenue district of Lunglei,
Lawngtlai* and Saiha*.
2. The Governor of Mizoram, after consultation with the
Gauhati High Court and in exercise of the aforesaid
powers, is further pleased to set up the following
criminal courts in addition to the existing Special
Courts Viz. the Court of Special Judge under the
Prevention of Corruption Act, the Special Court under ND
& PS Act and the Special Court under the Essential
Commodities Act, which shall also function as the courts
of Additional Sessions Judges, in the above mentioned
Sessions Divisions, namely:-

In Aizawl Sessions Division-
1.1.1
One court of Sessions Judge, three courts of Additional
Sessions Judges, one Court of Chief Judicial Magistrate,
and seven courts of Judicial Magistrate of the First
Class at Aizawl and at other places as per the details
given in Schedules-I & II.

of Judicial Magistrates of the First Class at Champhai
and at other places as per the details given in

In Lunglei Sessions Division-
1.2.1
One court of Sessions Judge and, two*
courts of Additional Sessions Judge, one Court of Chief
Judicial Magistrate, and five courts of Judicial
Magistrate of the First Class at Lunglei [and at other
places as per the details given in Schedules I & II]*.
2.2.2* One Court of Chief Judicial Magistrate at
Lawngtlai and three other courts of Judicial Magistrate
of the First Class at Lawngtlai and at other places as
per the details given in Schedules I & II.
2.2.3* One Court of Chief Judicial Magistrate at Saiha
and three other courts of Judicial Magistrate of the
First Class at Saiha and at other places as per the
details given in Schedules I & II.
3. The jurisdiction of these courts as outlined by
the Gauhati High Court shall be as follows:-
3.1.The Sessions Judge/Additional Sessions Judges at
Aizawl shall exercise territorial jurisdiction over the
undivided Aizawl administrative district comprised of
Aizawl, Kolasib, Champhai, Serchhip and Mamit districts.
The existing Special Courts shall exercise the same
territorial jurisdiction of the respective Special Court
as notified at the time of their creation.
3.2.The Chief Judicial Magistrate and Judicial
Magistrates of the First Class in the Aizawl Sessions
Division shall exercise territorial jurisdiction within
the areas of their respective administrative district,
as specified in Schedules-I and II to this notification.
3.3. The Sessions Judge/Additional Sessions Judges at
Lunglei shall exercise jurisdiction over the entire
Lunglei Sessions Division. [*]
3.4. The Chief Judicial Magistrate and the Judicial
Magistrates of the First Class in the Lunglei Sessions
Division shall exercise territorial jurisdiction within
the areas of their respective administrative district,
as specified in Schedules I & II to this notification.
4. As the districts of Serchhip, Mamit [and Lawngtlai]*
do not have proper court-establishments like staff,
jails etc., the Gauhati High Court may empower the
Executive Magistrates posted in the sub-divisions of
such districts as Special Judicial Magistrates under
section 13 of the Cr PC for the time being and as may be
requested by the state Government.

in exercise of powers conferred by section 3-6 read with
all other enabling provisions of the Mizoram Civil
Courts Act, 2005 and Sections 6, 7, 9, 11 and 12 of the
Code of Criminal Procedure, 1973 (Act No. 2 of 1994),
the Governor of Mizoram is pleased to reconstitute
Criminal and Civil Courts as follows:-

Respective
territorial jurisdiction of these courts shall continue to remain same as
determined at the time of their establishment and as specified in the
notification dt. 07/01/2008, dt. 02/06/2008 and 07/10/2008. This issues in
pursuance of the Hon’ble Gauhati High Court’s communication Vide No. H.C.
VII-193/2010/11974/A dt. 22/11/2010.

2nd Court of Additional District & Sessions Judge, Aizawl Judicial
